2. Subject of the Processing
The Controller will process the personal data transmitted by the user while browsing the Site (first name, last name, email, phone, gender, date of birth, city) solely for the purposes indicated in this notice and in order to comply with legal obligations.
3. Purpose of the Processing
The purposes of processing pursued in general by the Controller can be summarized as follows:
user data are collected to allow the Controller to provide its services, as well as for the following purposes:
- to provide the user with our services, products, and features;
- to measure and improve such services, products, and features;
- to protect users and provide customer support;
- to inform users about updates, events, activities, and opportunities related to our services, products, and features. You can unsubscribe from this last purpose at any time easily and quickly—just click the "Unsubscribe" link included in every newsletter.
- to forward user requests aimed at obtaining information and receiving informational material (e.g., information requests, quotes) to our advertiser companies.

The data processed will be those, as described above, strictly necessary to provide the requested service.

5.1 Processing of Children's and Minors' Personal Data
The services offered by Travel365guides.com are intended only for persons over 16 years of age. For persons under 16 years of age, the use of our services is allowed only with the consent of parents or a legal guardian. Travel365guides.com may collect and use information from minors only with the consent of parents or legal guardian. If we become aware of the processing of data of persons under 16 years of age without the valid consent of a parent or legal guardian, we reserve the right to delete such data.
6. Methods of Processing
Your data are collected and recorded lawfully and fairly for the purposes indicated above and are also processed with the aid of electronic and automated tools, including by entering and organizing them in databases, in accordance with the GDPR provisions on security measures and, in any case, in such a way as to ensure the security and confidentiality of the data themselves.
7. Data Transfer
The management and storage of personal data will take place on servers of the Controller and/or of appointed third-party companies, located within the EU, and no transfer of such data outside the territory of the European Union will be carried out.
8. Data Retention Period
The Controller will retain the personal data provided for the time necessary to fulfill the purposes described above, up to a maximum of 10 years.
9. Data Security and Storage Procedures
We rely on specific procedures to prevent unauthorized access to data, as well as their misuse.

10. Data Subject Rights

- where processing is taking place, obtain access to the data and information relating to the processing, as well as request a copy of the data themselves;

- obtain, where one of the conditions set out in Article 17 of the GDPR applies, the erasure of the data concerning you;
- obtain, in the cases provided for by Article 18 of the GDPR, the restriction of the processing of the data concerning you;
- receive the data concerning you in a structured, commonly used and machine-readable format and request their transmission to another controller, if technically feasible.
10.1. Right to Object
Pursuant to Article 21 of the GDPR, you will also have the right to object at any time to the processing of your data carried out for the pursuit of the Controller's legitimate interest by writing to the email address indicated in Article 1 above. In case of objection, the data will no longer be processed, provided that there are no legitimate grounds for processing which override the interests, rights and freedoms of the data subjects, or for the establishment, exercise or defense of legal claims.
10.2. Right to Lodge a Complaint with the Supervisory Authority
The Controller further informs you that you may lodge a complaint with the Italian Data Protection Authority if you believe that your rights under the GDPR or any other applicable regulation have been violated, according to the procedures indicated on the website of the Authority accessible at: www.garanteprivacy.it.
10.3. Right to Data Erasure
You may delete your data at any time or request their deletion as provided for by Article 17 of the European regulation on personal data protection via the control panel (10.3.1) or by filling out the form (10.3.2):

- Click confirm to permanently delete your data;
- Log in by clicking the "Profile" button (top right);
- from the profile page, click the "Delete Account" button;
- Click the "I confirm account deletion" button to permanently delete your data
10.3.2 Deletion Procedure via FORM
To request deletion, submit a request through the form by clicking here: "General questions, delete account or reports?".
Within 72 hours of the request we will delete all your data and provide you with confirmation of the deletion.
Emade Srl, as data controller, reserves the right to continue processing the data if they are still necessary for the purposes for which they were collected and where there is a legal basis for their processing, namely:
- for the exercise of the right to freedom of expression and information;
- for compliance with a legal obligation that requires processing under the law of the Union or the Member State to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
- for reasons of public interest in the area of public health;
- for archiving purposes in the public interest, scientific or historical research purposes, or statistical purposes, insofar as erasure is likely to render impossible or seriously impair the achievement of the objectives of such processing;
- for the establishment, exercise, or defense of legal claims.
11. Nature of Data Provision and Consequences of Refusal to Provide
Providing data for the purposes indicated in Article 3, specifically numbers 1, 2 and 3, is necessary and mandatory. In their absence, it will not be possible to provide you with the described services.
It is not mandatory, however, for the purposes indicated in the same article, specifically number 4, for which you may decide not to give consent.

- Travel365guides.com is a community of free travelers, where travel ideas, plans, places, itineraries, and dreams are discussed and commented on. To do so, everyone must read and fully comply with the terms and conditions of use.
- Use of the Sites is free and non-binding. If you use the Services, you automatically accept the terms and conditions of use set out below.

- Where required to use the Services, you must complete the registration information form and fully accept these General Conditions: the personal data you provide by completing the form will be processed in compliance with and according to the methods established by Legislative Decree 196/2003 on privacy protection, of which information is provided prior to registration.
- By accepting the General Conditions, you declare that your data are up to date, correct, and truthful, and you undertake to modify them promptly so that they are constantly up to date, complete, and truthful. Where permitted, you may use a pseudonym or nickname associated with your real identity, which must be provided to Travel365guides.com so that it can be communicated to the Judicial Authority in cases provided for by law.
- Your right to use the Services is personal and non-transferable: you undertake not to resell or otherwise make commercial use of the Services provided by the Site.
2. Ownership, Site Content, Copyright and Trademarks
- The Sites and all content, understood as trademarks, logos, icons, texts, are the exclusive property of Emade srl, except for user-generated content, governed according to the Terms of Use for user-generated content available here.
- Emade srl provides no warranty on the content present on the Site and disclaims any liability in relation thereto.
- Downloading and general use of the content of the Sites is permitted for private purposes only, except in the case of companies where expressly provided: the User expressly acknowledges and accepts the prohibition on reproducing, copying, transmitting, selling, publishing, or commercially exploiting the content. 3. Suspension of Services
- Emade srl reserves the right to suspend or discontinue, even permanently, at any time and without notice, the provision of the Services.
- Emade srl disclaims any liability in relation to potential damages caused by interruption of the Services, including those resulting from blackouts or failures of the Sites’ servers or of third-party providers of Emade srl.
- Emade srl reserves the right to discontinue the Services for the needs of maintenance or updating of its own or third-party providers’ IT systems, without the obligation to inform Users in advance.
- Emade srl disclaims any liability for damages, claims or losses, direct or indirect, that may result to you from the failure and/or defective operation of your or third parties’ electronic equipment, or telephone and/or telematic connections not directly managed by it or its suppliers.

- The Sites may include hyperlinks to other websites operated by third parties, including advertisements and other content providers. These sites may collect data or request personal information from you. Emade srl does not exercise, nor is it required to exercise, any form of control and therefore disclaims any liability for damages, claims or losses, direct or indirect, that may result to you in any form from viewing, using and/or operating third-party sites or services reached through such links.
- The Sites participate or may participate in affiliate programs that allow the receipt of an advertising commission based on certain user actions, such as, by way of example and not limitation, clicks, views, purchases, bookings. However, affiliations do not increase the price of the advertised product/service; therefore the user will not pay any extra. 5. Intellectual property rights over Content
- You expressly acknowledge that all industrial and intellectual property rights, protectable on the basis of the rules relating to copyright (Title IX of Book V of the Civil Code, Articles 2575–2594, as well as Law No. 633/1941, as amended by Legislative Decree No. 169/1999) and/or the Industrial Property Code, approved by Legislative Decree 10.2.2005 No. 30, or other provisions, protecting, by way of example and not limitation, know-how, source code, software, hardware, designs, applications, patents, trade secrets, formulas, algorithms, models, databases and the like, relating to the Services, data and other materials from the Sites or from third parties, in any case made available on the Sites or through the Services under the General Conditions ("Content"), EXCEPT FOR USER-GENERATED CONTENT (UGC) GOVERNED ACCORDING TO THE Terms of Use for user-generated content ("UGC Terms of Use") OF THESE TERMS AND CONDITIONS OF USE, are and remain the exclusive property of Emade srl, which grants you a personal, non-transferable and non-exclusive license to use the Content and Services in accordance with the General Conditions, it being understood in any case that you may not copy, modify, sell, assign, sub-license, grant or transfer to third parties or create derivative works from any industrial and intellectual property right of Emade srl, nor allow third parties to do so through you or your computer, even without your knowledge.

Terms of Use for User-Generated Content ("UGC Terms of Use")
These Terms of Use for user-generated content ("UGC Terms of Use") describe the terms and conditions under which Emade srl may use content created and published by you.
Premise
- Users of the Sites may be allowed to submit content for publication in various areas of the Sites. Interactions with the Sites are governed by our User Conduct Rules, which are incorporated into these terms and conditions. If you choose to post content or comments on the Sites, you will be deemed to have expressly accepted these guidelines and these terms and conditions.
- When you submit content to the Sites, you agree and declare that you have created such content or have received authorization from the owner of any part of the content or are authorized to submit it to the Sites.
1. User Conduct Rules
- You are responsible for any activity within the Site that occurs under your username;
- You are responsible for safeguarding your access credentials and you undertake to hold Emade srl and the Sites harmless and indemnified from any claims or demands from any party arising from the use or misuse of the Services by third parties through the use of your password.
- Not permitted:
- harassing, threatening, annoying, provoking, insulting, and generally disturbing other users;
- using provocative, vulgar language or language that is offensive to the dignity of others;
- promoting products, services or websites without prior authorization from Emade srl, by submitting a request by email to info@travel365guides.com;
- sending unsolicited messages to other users;
- transmitting, posting, uploading, disseminating or promoting content that is obscene, vulgar, defamatory, sexist, homophobic, xenophobic or offensive to others' dignity or that may in any way offend a person;
- more than one account belonging to a single person.
- Emade srl reserves the right to verify, at any time and without notice, at its discretion, compliance with the General Conditions in your use of the Services; if you do not comply with the rules, Emade srl may modify or delete your comments and discussions. Furthermore, if this should happen repeatedly, Emade srl may block your account and permanently and without notice discontinue the provision of the Services to you. You may submit a request to delete your account at any time by sending a request to info@travel365guides.com. In this case, your previously posted comments or discussions will remain on the web page to preserve the sense and context of the discussion.
The data you provide will never be disclosed or transferred to third parties. - Minors must complete the registration process with the assistance of a parent or legal guardian. Those who, exercising parental authority over minors, allow them to use the Services are responsible for the minor's online behavior, for controlling access, and for the consequences in case of misuse of the Services by the minor.
2. Important notice: this is a contract
By clicking "I Accept," you agree to be bound by these UGC Terms of Use, without limitation or qualification. Emade srl reserves the right to amend these UGC Terms of Use by publishing new versions, as well as the right to provide further notice of material changes, which will become effective immediately.
3. Rights
- You or the content owner still hold the copyright of the content submitted to us, but by submitting the content to the Sites, you grant Emade srl a worldwide, perpetual, unconditional, irrevocable, non-exclusive, royalty-free, fully transferable right and license to publish and/or transmit or otherwise use and authorize third parties to use, publish and/or transmit or otherwise use such content, forever, on the Sites, understood as websites, blogs, mobile website, app, email and on digital and social media channels owned by Emade srl, in any format and on any platform, now known or hereafter invented.
- You acknowledge and agree that when you post content on the Sites or view content provided by others, you do so at your discretion and risk, including any reliance on the accuracy or completeness of such content. You further acknowledge and agree that the opinions expressed by you and other users in such content do not necessarily reflect the opinions of Emade srl and/or the Sites, and that we do not support or endorse any user content. You acknowledge and agree that we have no obligation to pre-screen, monitor, review, or edit any content posted by you or other users on the Sites.
- Emade srl or authorized third parties may modify, cut, crop, edit the content you submit for formatting, navigation, integration or other purposes, or refuse to publish it at our sole discretion. We may remove your content from use at any time.
- You acknowledge and agree that the technical processing and transmission of the Sites may involve (i) transmissions over various networks; and (ii) changes to the content to conform and adapt to the technical requirements of connecting networks or devices. Emade srl assumes no responsibility for the deletion or failure to store content or other information submitted by you or other users to the Sites.
- You acknowledge and agree that (i) the content you submit was created by you or that you own or control all rights to such Content; (ii) Emade srl's exercise of its rights under these UGC Terms of Use will not violate third-party rights or any applicable laws, rules, or regulations, including, without limitation, consumer protection, privacy, and commercial laws; and (iii) the Content you submit does not contain worms, viruses, or other malicious code.
4. Warranties
- You warrant that the content you submit to the Sites is not obscene, threatening, harassing, slanderous, misleading, fraudulent, invasive of another's privacy, offensive, defamatory of any person, or unlawful.
- You warrant that the content you submit to the Sites does not infringe any patent, trademark, trade secret, copyright or other intellectual, proprietary, or privacy rights of parties or individuals.
- You warrant that you will not (i) post content intentionally intended to upset or harm other users; (ii) use the Sites to post or otherwise transmit content that victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of any non-permitted classification, including, without limitation, religion, gender, sexual orientation, race, color, creed, ethnicity, national origin, citizenship, age, marital status, military status, or disability; (iii) post or otherwise transmit any content that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of the Sites or any computer software or hardware or telecommunications equipment; (iv) upload or otherwise transmit any content or take any other action in connection with your use of the Sites that would constitute or would otherwise encourage criminal conduct or give rise to civil liability; or (v) use the Sites for commercial purposes, including, without limitation, sending material to solicit funds or to promote, advertise, or solicit the sale of goods or services.
5. Limitation of liability
- To the maximum extent permitted under applicable law, Emade srl, any third-party sublicensor of Emade srl, and its and their officers, directors, employees, contractors, and agents, are not liable for any direct, incidental, consequential, special, indirect, punitive or similar damages arising out of or resulting from the content you submitted, including, without limitation, business damages, loss of profits, loss of savings, or loss of earnings, however caused, whether based in contract, in tort (including negligence) or any other theory of liability. The foregoing limitations apply regardless of whether the indemnitee or third-party content provider has been advised of the possibility of such injuries, damages, losses or expenses.
- If the content you submitted causes any inconvenience, malfunction or technical interruption, you agree to be responsible for any and all liability and costs and expenses (including attorneys' fees and legal expenses) arising from any and all claims made by third parties based on such inconveniences, malfunctions or technical interruptions. Without limiting the foregoing, you will be personally responsible for any damage, loss, cost or expense (including legal expenses and attorneys' fees) arising from the infringement of property rights or from any other damage resulting from your content.
6. Indemnification and release
- You agree to indemnify, defend and hold harmless Emade srl, its agents, suppliers, licensees, successors or assigns and/or its and their respective officers, directors, employees, contractors and agents (collectively, the "Indemnified Parties") from and against any damages, liabilities, claims, actions, demands and costs (including, without limitation, reasonable legal fees and transaction costs) arising from any breach by you of these UGC Terms of Use.
- Without limiting the foregoing, you release each of the Indemnified Parties from all damages, liabilities, claims, actions, demands and costs of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with these UGC Terms of Use.
7. Term
These UGC Terms of Use are valid until terminated by Emade srl, with or without notice. Those terms and conditions of these UGC Terms of Use that, by their nature, are intended to survive termination (by way of example and not limitation: Limitation of liability, indemnification and release) will continue to survive and be valid.
8. Choice of law; venue
These UGC Terms of Use are governed by the internal substantive laws of the Italian State, regardless of conflict-of-law principles. Jurisdiction for any claims arising from these UGC Terms of Use lies exclusively with the Court of Marsala. To the maximum extent permitted by applicable law, no claim under these UGC Terms of Use may be joined with any other claim and no class action proceedings shall be permitted.
9. Entire agreement / waiver
- These UGC Terms of Use constitute the entire agreement between you and Emade srl in relation to User-Generated Content.
- The failure of Emade srl to exercise or enforce any right or provision of these UGC Terms of Use shall not constitute a waiver of such right or provision.
- If any provision of these UGC Terms of Use is held invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these UGC Terms of Use, which shall remain in full force and effect.
- These UGC Terms of Use and any notice given in electronic form are admissible in judicial or administrative proceedings based on or related to these UGC Terms of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
